Today it was announced that the Ramsey County District Court invalidated the binary trigger provision included in the final 1400+ page omnibus bill that was pushed through by Democrats in the final minutes of the 2024 legislative session. The final hour of session came under heavy scrutiny, as this omnibus bill included dozens of issue areas, and was forced through without debate, giving legislators no opportunity to read or even see the bill.
In February, the Minnesota Gun Owner’s Caucus filed a complaint asking for the provision in the bill prohibiting “binary triggers” to be struck the grounds that the bill violated the Single Subject Clause in Article IV, Section 17 of the Minnesota Constitution.
“Make no mistake, the legislature violated the constitution on the last night of the 2024 session. Today, Judge Castro, a Gov. Dayton appointee, invalidated one part of the 1,432 page mega-omnibus bill for violating the single-subject clause of the Constitution, but he came very close to striking down the entire bill,” said Senator Michael Kreun (R-Blaine). “Judge Castro believed the entire bill should be struck down but only invalidated the provision at issue in the lawsuit due to appellate precedent. His strong language criticizing the bill certainly is inviting an appellate court to rightfully strike down the entire bill. Rolling bills on multiple subjects into one giant omnibus bill is not only unconstitutional, but they are also an affront to transparency, accountability, and good government. We need to do a better job in how we legislate in Minnesota, and I am committed to being a voice for better government.”
